Canada Trademark Search

  • A comprehensive name search is the essential first step to take before using a trademark. This is necessary because you can be sued for trademark or trade name infringement not only for using someone else's exact name, but also for using a confusingly similar name. For example, zerox and zerax would be considered confusing with xerox, but they wouldn't come up in an exact-match search. Therefore, to protect yourself from legal action you must also do a search for similar trademarks. We offer a special search that do so.

    We use the NUANS database, which is compiled by Industry Canada and contains over 8 million records. It includes the federal government's databases of corporations and registered trademarks, as well as the corporate, trade name and business name registrations from most provinces. The trademark search can also be 'biased' towards the wares and/or services you are offering. These NUANS reports are only available through an official NUANS Name Search House, of which we are one. We use the most detailed Industry Canada trademark search available, the Extended Trademark Search Report.

    Each NUANS Report is reviewed by a registered trademark agent. We provide you with our comments and also with our Official Opinion as to whether the proposed trademark is a good candidate for registration. This Opinion is at the heart of our report and relies on years of business name and trademark experience and an understanding of the complex law of trademarks.
